About Us

AnatomyPrint is an online service ("Service") available trough the website anatomyprint.materialise.Com which allows the user to order 3D Printed models ("Models") of anatomical data files (" Anatomical Data File") for the sole purpose of visualization of a person's anatomy ("Purpose").

The Service is offered by:

 

Customer Account

The Service is only offered to professional customers and not to consumers. To use our Service you can create an account protected by a password. An account is personal and may only be used by you. You are responsible for maintaining the confidentiality of your password and all orders placed under your account. You will immediately inform Materialise in case of unauthorised use of your account, loss of password or any other issue that might comprise the integrity and safety of our Service. Materialise is not liable for any loss or damage, arising from your failure to protect your account and/or your password.

Anatomical Data File & Models

You have full control over and liability for the Anatomical Data File. The quality of the Model depends on the quality of the Anatomical Data File. You represent and warrant to Materialise that the following conditions relating to the Anatomical Data File have been met: - The Anatomical Data File is based upon a person’s anatomy from who you have acquired the necessary consent or whom you have sufficiently informed under the applicable laws. - The Anatomical Data File was produced with software that has been approved and/or cleared by the applicable regulatory authorities. Materialise recommends you use Materialise Mimics Software to produce Anatomical Data Files. The Model may only be used for the purpose of visualising an anatomical part of a living organism. Any other purpose is hereby explicitly excluded. This means by way of example that the Model may not be used in any way for the diagnosis or treatment of a disease or for the planning or execution of a surgery. You expressly acknowledge that Materialise is not in the position to act as a medical professional.

Step 1: You upload the Anatomical Data File in the required file format.

Step 2: You choose the requested specifics (e.g. material, finish, size …) of your Model.

Step 3: After selecting the country of delivery, you receive an overview of the cost of your order.

Step 4: You chose the method of payment.

Step 5: You can go back to any of the previous steps or confirm your order. You order is an offer to purchase our Service.

Step 6: Materialise will verify whether your file meets the requirements:

  •  If your file does meet the requirements, you will receive a confirmation of your order. Once we have confirmed your order, a contract has been concluded between you and Materialise. Cancellations are not possible after confirmation as the production process of your order starts immediately.
  • If your file does not meet the requirements (e.g. Anatomic File Generation) or the production of the Model, you shall not receive an e-mail confirmation Materialise shall contact you as soon as possible to resolve the issues and find a solution. If no solution can be found, you shall be reimbursed. 
  • Although the AnatomyPrint platform is built to detect a wide range of possible problems with Anatomical Data Files, it may happen that even after you receive a confirmation of an order, Materialise finds the Anatomical Data File cannot be printed into a Model due to technical reasons. Therefore, Materialise may, at any time during the ordering and manufacturing process, revoke and/or cancel any quotation/order for technical reasons. In such cases, Materialise shall contact you as soon as possible to resolve the issue and find a solution. If no solution can be found, you shall be reimbursed.

Price - Payment

The price calculated during the ordering process includes the production and shipment of the Model. The price is calculated in Euro or Dollar, depending on your choice.

Offsetting against any kind of non-approved counter-claims as well as execution of right of retention of goods shall be excluded unless established in court, undisputed or recognised by Materialise. Materialise remains the sole owner of the products until their entire payment, transport and taxes included.

Separate parts of an order can be invoiced separately. Materialise reserves the right to refrain from execution of further components of a quote, or of a following quote, or to terminate a delivery, as long as the outstanding issued invoices remain unpaid. Materialise retains full legal title to products until it has received in full all amounts due on those products and payment on any other products that you have ordered.

 

Materialise acts according to its mission, which is to make the world a better and healthier place to live. Therefore, Materialise reserves the right to refuse at its own discretion and at all times an order that is in conflict with its mission and value statement.

Production, Delivery and Shipment

The average time required to produce a Model depends on the production process:

  • -minimum 6 working days for SLS
  • minimum 9 working days for SLA, CJP, FDM and HP Flex

However, these are theoretical times. The actual production time is determined by a number of circumstances such as the general work load at the moment of ordering, the punctual delivery of the raw materials to Materialise, etc. If your payment details are incorrect or your payment is not processed correctly, the delivery of your Model will be postponed until you have resolved the issue.

All production and delivery times are therefore non-binding.

Materialise uses its discretion in selecting a reputable carrier and appropriate means of shipment and delivery. All risks during transport are borne by you.

Inspection of received models - Complaints

Once you receive the Model, you shall inspect the Model thoroughly. If, upon inspection, you find that the Model is not in conformity with your order, you should contact Materialise as soon as possible and at the latest 7 days after the receipt of the Model. If Materialise does not receive any complaints within the 7 days after the receipt of the Model, you will be deemed to have accepted the Model.

Only if agreed upon by Materialise, you may return the Model in the same packaging as it was delivered to you.

Intellectual Property and Third Party Rights

Materialise, the Materialise logo and Mimics are trademarks of Materialise and may not be used by you without the prior, written consent of Materialise. The website of the Service contains names, signs and devices of third parties that may be protected by one or more intellectual property rights. You may only use these with the consent of the appropriate rights holders.

Materialise is the copyright holder of the website of the Services. No part of the website may be copied or reproduced without the prior, written permission of Materialise.

The Service provides an automated internet-based service to you. Materialise prohibits you from using the Service to order and/or sell Models that infringe any third party rights including privacy rights, data protection rights, patient rights or intellectual property rights (“Third Party Rights”).

You are solely responsible for the Anatomical Data File that you upload to the website.

However, if Materialise finds that your Anatomical Data File is or risks to be an infringement upon Materialise’s or any Third Party’s Rights, Materialise reserves the right to refuse to produce or deliver your Model. If your Anatomical Data File is found to infringe any Third Party Rights or violate any law, you will defend Materialise against all third party claims, and be held liable for all direct and indirect damages and costs incurred by Materialise with respect to such claims, including reasonable attorney’s fees.

You acknowledge that electronic communications, databases and websites are subject to errors, malfunctions, tampering and break-ins, or that use thereof may result in damages to your systems or operations. While Materialise will implement reasonable precautions to attempt to prevent such occurrences, you further acknowledge that Materialise does not guarantee such events will not take place and that Materialise will not be liable for any such occurrences.

You shall be solely responsible for ensuring that any information or content uploaded to the website does not contain any virus or other computer software code or subroutine designed to disable, erase, impair or otherwise damage its systems, software or data, and you shall indemnify, defend and hold Materialise harmless from any liability, claim, cost or damage arising out of any third-party claim or suit caused by such virus or code or subroutine.

Guarantees and warranty

Materialise guarantees that the Model shall substantially meet the features of the Anatomical Data File and the chose options on the website, within the limitations of the current 3D printing technology. Materialise will decide solely about the building orientation of the Model. A Model cannot be refused because of the chosen printing orientation. Because of production reasons (different print orientation, composition of raw materials, etc.), there may be minor visual differences between multiple copies of one model.

MATERIALISE MAKES NO WARRANTY OTHER THAN THOSE MADE EXPRESSLY IN THIS TERMS AND CONDITIONS TO THE FULLEST EXTENT PERMITTED BY LAW. MATERIALISE HEREBY EXPRESSLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.

Limitation of liability

ALL INFORMATION AND CONTENT ON OR OBTAINED THROUGH THE SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. YOU HEREBY WAIVE ALL OTHER WARRANTIES RELATING THERETO, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY AGAINST INTERFERENCE OR INFRINGEMENT.


MATERIALISE DOES NOT WARRANT THAT THE USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY ERROR OR DEFECTS WILL BE OR CAN BE CORRECTED. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, IN WHICH CASE SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO ALL USERS.

MATERIALISE SHALL NOT IN ANY EVENT BE LIABLE TO ANY USER OR TO ANY THIRD PARTY FOR ANY DIRECT DAMAGES, LOST PROFITS, REVENUES, BUSINESS OPPORTUNITIES OR FOR LOSS OF INCOME, BARGAIN, REVENUE, CONTRACTS, GOODWILL, USE, ENJOYMENT, TIME, DATA, ELECTRONICALLY TRANSMITTED ORDERS OR OTHER ECONOMIC ADVANTAGE WHATSOEVER (BUT NOT TO THE EXTENT THAT APPLICABLE LAW PROHIBITS LIABILITY EXCLUSIONS OR LIMITATIONS FOR INTENTIONAL TORTS, GROSS NEGLIGENCE,  DAMAGES ARISING OUT OF PRODUCT LIABILITY OR OTHER FAULT BASES), NOR FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, PUNITIVE OR INCIDENTAL LOSSES, DAMAGES OR EXPENSES DIRECTLY OR INDIRECTLY RELATING TO THE USE OR MISUSE OF THE WEBSITE, OR THE INFORMATION OR CONTENT, IRRESPECTIVE OF THE BASIS FOR SUCH CLAIM.

UNDER NO CIRCUMSTANCE CAN MATERIALISE BE HELD LIABLE FOR ANY PRODUCT DEFECTS OR SPECIFICATIONS WHICH HAVE BEEN REQUESTED/ANALYSED IN THE QUOTATION PHASE. THE LIABILITY OF MATERIALISE TOWARDS YOU FOR REAL AND PROVEN DAMAGE WILL, REGARDLESS THE SEVERITY OF THE FAILURE, BE LIMITED TO THE PRICE OF THE PRODUCT DIRECTLY RELATED TO THE REASON OF THE CLAIM.

Data protection

Personal Data

By submitting orders:

  •  you consent to the processing of data personal to you, such as your name and title, address, telephone number, contact details and other personal details (“Personal Data”), in accordance with the terms of Materialise; subject to the situation that these Personal Data are required to process your order and to fulfil our legal obligations.
  •  you acknowledge that the processing of your Personal Data is necessary for the performance of the contract and you consent to such processing.

In certain circumstances Materialise may seek additional personal information such as photocopies of identification documents or credit cards for example for identity verification or fraud prevention purposes. Where such additional information is submitted to Materialise it shall also be regarded as Personal Data.

The Personal data are collected by Materialise in order to:

  •  fulfil its obligations under any sale and purchase contract and any other contract with you
  •  ask your opinions on its products and services - provide you with the latest products and services information
  •  improve the products and services for you

Materialise may share, make available or transmit Personal Data to other departments and divisions in Materialise, and other Materialise Companies within Europe and overseas, including Ukraine. Materialise will not disclose Personal Data to entities and persons, other than Materialise without your consent, except in the cases below. Personal Data may be disclosed to third parties to enable compliance with legal obligations to which Materialise or its Affiliates are subject. Personal Data may be disclosed to third parties to enable them to provide services for or on behalf of, or at the direction of, Materialise or other Materialise Companies. In such cases, Materialise takes measures to ensure that the third parties comply with Materialise’s privacy policy and that such recipients:

  •  do not use Personal Data other than for the purposes permitted;
  •  obtain and process Personal Data only on condition that they secure that Personal Data from unauthorised use and adopt and comply with similarly stringent policies and terms on Personal Data protection and use; and
  •  comply strictly with applicable laws.

Use of "cookies"

When you visit the site 'cookies' may be installed on the hard disk of your computer with the sole purpose of streamlining the site more to the needs of recurrent visitors. These mini files or cookies are not used to check the surf behaviour of the visitor on other websites. Internet browsers allow you to block the use of cookies. You receive a warning when a cookie is installed or that cookies can be removed from your hard disk afterwards. Please consult the help function of your Internet browser for this.

The sale of products and these terms shall be governed by and construed under the laws of Belgium. All disputes will be submitted to the exclusive jurisdiction of the Courts of Leuven.

Warranty

Materialise warrants that the printed model shall substantially meet the features of the ordered model within the limitations of the current 3D printing technology. Materialise will decide solely about the building orientation of the model. A printed model cannot be refused because of the chosen printing orientation. Because of production reasons (different print orientation, composition of raw materials,...), there may be minor visual differences between multiple copies of one model.

If the printed model is made of precious metals, Materialise warrants that the model will be in accordance with  the Belgian Precious Metals Marking Laws and Regulations.

MATERIALISE MAKES NO WARRANTY OTHER THAN THOSE MADE EXPRESSLY IN THIS TERMS AND CONDITIONS TO THE FULLEST EXTENT PERMITTED BY LAW. MATERIALISE HEREBY EXPRESSLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.
